CHAPA and BHA will be rallying support for An Act to Ensure Right to Counsel in Eviction Proceedings, submitted by Mayor Walsh as part of his Legislative Package. In Massachusetts, only six to nine percent of tenants are represented in eviction proceedings compared to the majority of landlords who are able to afford legal representation. The Act is necessary to equal the playing field for Massachusetts’ low-income tenants and to prevent the consequences of homelessness to tenants and Massachusetts taxpayers who pay the cost of expensive shelter programs.
The Act would provide certain low-income tenant households facing eviction with a court-appointed attorney for representation. These “certain low-income tenant households” would be defined as those with incomes under 200% of the federal poverty level or those that rely on various forms of public assistance, including but not limited to AFDC, food stamps, or Medicaid. The Act would also create a public task force to formulate a two-year implementation plan.
